Criminal Justice Network, owned by the association “Progetto giustizia penale” based in Milan, in compliance with current national and European legislation and in particular with the General Data Protection Regulation (EU) 2016/679 (GDPR)  (hereinafter referred to as: “Regulation”), performs personal data-processing for the following categories:

 

NAVIGATION DATA SUPPLIED BY WEBSITE USERS AND PROFILING

Criminal Justice Network only uses the following cookies:

1) Technical cookies for session data which are deleted each time the browser is closed. These cookies, sent from our domain, are required to correctly view the website and are pertinent to the technical services offered; they will therefore always be used and sent, unless the user modifies the browser settings (invalidating viewing of the website’s pages). Disabling cookies could mean that certain website services will not function correctly.

2) Performance cookies, used to collect data for statistical purposes on how the website is used. Personal information is not collected but the cookies are used to improve the user’s experience of the website and to provide content that reflects the interests of the user. This type of cookie collects anonymous data on the activity of the user and on how the user accesses the site. Performance cookies are transferred either from the site or from third party domains.

 

PERSONAL DATA SUPPLIED BY RECIPIENTS OF THE NEWSLETTER

The only piece of personal data collected by Criminal Justice Network through newsletter subscription, is the email address of the subscriber.

These data are collected for the purposes of scientific dissemination and legal information. They are processed subject to prior consent granted in accordance with the conditions set out in Article 7 et seq. of the Regulation and are stored for the duration of publication of the website, without prejudice to the right to erasure pursuant to Article 17 et seq. of the Regulation.

 

PERSONAL DATA SUPPLIED BY THE AUTHORS OF WEBSITE CONTENT

By means of online dissemination, the association “Progetto giustizia penale” collects, stores and shares any personal data relating to authors including political opinions, religious or philosophical preferences that are contained in contributions, including any multimedia sources, published on Criminal Justice Network.

Furthermore, through online dissemination the association “Progetto giustizia penale”, collects, stores and shares personal data, including photos, contained in the Curricula Vitae of the authors of the scientific studies sent to and/or published on Criminal Justice Network and in the Diritto penale contemporaneo – Rivista trimestrale.

Personal data supplied by the authors of contributions are collected for the purposes of research and scientific dissemination. They are processed subject to prior consent granted under the conditions set out in Article 7 et seq. of the Regulation and are stored, for the duration of publication of Criminal Justice Network  without prejudice to the right to erasure pursuant to Article 17 et seq. of the Regulation.

 

PERSONAL DATA RELATING TO CRIMINAL CONVICTIONS AND OFFENCES

By means of online dissemination, the association “Progetto giustizia penale” collects, stores and shares personal data relating to criminal convictions and offences contained in legal judgments, either Italian or foreign, published directly on Criminal Justice Network, pursuant to the rights recognised by the Regulation, as well as the provisions in art. 114 of the Code of Criminal Procedure and 51 and 52 of the Legislative Decree of  the 30th June 2003, n. 196.

Personal data relating to criminal convictions and offences are only collected for the purposes of research and scientific dissemination. Said data are taken from data banks accessible to the public or from the court clerks or secretaries of the relevant Judicial Authorities and are stored, for the duration of Criminal Justice Network’s publication, without prejudice to the right to erasure pursuant to Article 17 et seq. of the Regulation.

DATA SUBJECT’S RIGHTS

Any natural person identified or identifiable through personal data used by the association “Progetto giustizia penale” can ask the data controller for access to said data, for correction, erasure, restriction of processing, or portability pursuant to, Article 15 et seq. of the Regulation.

Wherein data processing is based on express consent of the individual to whom the personal data refers, consent can be revoked at any time without affecting the lawfulness of the data processing based on consent before withdrawal.

Any natural person identified or identifiable on the basis of the personal data processed by the association “Progetto giustizia penale”, can report a breach to the Data Protection Authority.
